Supreme Court Judgements


Over the years the Supreme Court of India has passed numerous judgments that significantly impact, adversely & otherwise, the followers of Dharma namely Sanatan, Bauddhic, Jaina and Sikh. So esamskriti thought it would be a good idea to create a database of such judgments.

  1. SC quashes UPA govt notification on Illegal Migrants December 2006 by Sanjeev Nayyar - In a major setback to the UPA government at the Centre, the Apex Court on Tuesday quashed its notification that put the onus of proving an llegal immigrant into the country solely on the complainant. An SC bench directed the Union government to constitute within four months sufficient number of tribunals to detect infiltration of thousands of Bangladeshis into Assam.   6. SC Repeals the Illegal Migrants (Determination by Tribunals) Act, 1983, July 2005 - Assam has been a victim of illegal infiltration from Bangladesh for over two decades. Due to the policy of vote bank politics these infiltrators were never deported. The onus of proof as illegal migrants lies on the prosecution under IMDT Act, which is opposed to the Foreigners Act, 1946 under which the onus is on the suspected foreigners. Demographic composition of many districts has changed due to infiltration. For reasons given in the judgment the SC repealed the Act. To read judgment - Click Here

  9. No State quotas in pvt institutions - SC judgment of August 2005 - No state quotas, reservations in pvt insitutions’ read the Hindustan Times headlines of August 13. It did not matter whether the private institution was run by the majority of minority community. The Apex court also directed that taking capitation fees would no longer be permitted, gave unaided institutions the unfettered right to choose students and lay down the procedure for this provided the exercise was fair, transparent and on-exploitative.
